Intellectual Property Registration

1

Introduction & Importance

A trademark is a unique sign, design, or expression which identifies products or services of a particular source from those of others. In Bangladesh, Trademark Registration is administered by the Department of Patents, Designs and Trademarks (DPDT) under the Ministry of Industries. Why is Trademark Registration Essential? • Legal Protection: Grants exclusive rights to use the mark and prevents others from using similar marks. • Brand Identity: Builds trust and recognition among customers. • Asset Value: A registered trademark is an intangible asset that can be sold, licensed, or used as security. • Global Expansion: Provides a basis for international registration.
2

Necessary Documents & Information

To initiate the registration process, the following documents and information are required: • Mark/Logo: A clear representation of the trademark (Logo, Name, or Device). • Applicant Details: Full name, address, and nationality of the applicant (Individual or Company). • Goods/Services: A detailed list of products or services to be covered under the mark. • Class: The specific class(es) under the NICE Classification (1-45). • User Date: Date of first use in Bangladesh (if already in use) or "Proposed to be used". • Power of Attorney: An original or attested General Power of Attorney (GPA) or Power of Attorney (PA) if using an agent. • Trade License: Copy of the Trade License (for local companies).

Registration Steps & Timeline

Step 1: Trademark Search & Application

First, ensure your desired name/logo is not already registered. • Search Fee: 2,000 BDT + VAT (Timeline: 2-3 weeks) • Application Fee: 5,000 BDT + VAT (Timeline: 1 day) • Result: Once applied successfully, you can start using the TM mark.

Step 2: Examination

The DPDT officer will verify the application from a legal perspective. • Fee: 4,000 BDT + VAT (Timeline: 2-3 months) • Note: If any issues are found, a show-cause notice is issued, requiring a response within 2 months.

Step 3: Journal/Gazette Notification

If the examination is passed, the mark is published in the official gazette. • Fee: 3,000 BDT + VAT (Timeline: 6-9 months) • Note: This period allows others to file an opposition if they have objections.

Step 4: Registration Certificate

After the opposition period, the final certificate is issued. • Fee: 20,000 BDT + VAT (Timeline: 1 month) • Result: You can now use the ® mark.

Frequently Asked Questions

Q: What is the difference between TM and ®?

TM is used when a trademark application has been filed but not yet registered. ® is used only after the trademark is officially registered and the certificate is issued.

Q: How long does the registration process take?

The entire process typically takes 18 to 24 months, depending on whether there are any show-cause notices or oppositions.

Q: Can I register a slogan or a sound?

Yes, slogans, logos, names, and even distinctive sounds or smells can be registered as trademarks if they distinguish your goods/services.

Q: How long is a trademark valid?

Initial registration is valid for 7 years. It can be renewed indefinitely every 10 years.

Q: Is a Bangladesh trademark valid globally?

No, trademark rights are territorial. A registration in Bangladesh only provides protection within the country. For global protection, you must apply in each country or use the Madrid Protocol (if applicable).
